Bylaw 12075

To provide a Site Specific Development Control District to accommodate the expansion of a Public Education Services Use (NAIT Northern Alberta Institute of Technology) with associated private education, recreational, residential and commercial uses. Through the use of special architectural, site planning, landscaping and urban design related features, the overall development of the site shall achieve a high standard of appearance and, to the extent possible, be integrated with the adjacent NAIT facilities.
This DC5 District, containing approximately 5.6 ha (13.8 ac.), shall apply to Lot B, Plan 912 1885, located between 106 Street and 103 Street, and 118 Avenue and Princess Elizabeth Avenue; Spruce Avenue, as shown on Schedule "A" appended to the Bylaw adopting this DC5 District.

A Development Concept Plan, including a Landscaping Plan, shall be submitted with, or prior to, the submission of a development permit application.
The maximum building height shall not exceed 23 m (75.5 ft.) nor 6 stories nor that determined by Section 810 of the Land Use Bylaw, being the Airport Protection Overlay.
The maximum Floor Area Ratio (FAR) shall be 3.0
A minimum Yard of 7.5 m (24.6 ft.) shall be required where a site abuts a public roadway
Notwithstanding clauses 4(b), (c) and (d) above, the maximum FAR may be increased to 4.0, the maximum building height may be increased to 40 m (131.23 ft.) or 10 stories and the minimum yard requirement may be decreased to 3 m (9.84 ft.) if, in the opinion of the Development Officer, the site is being developed on a comprehensively planned basis whereby the potential adverse impacts that could otherwise be associated with the more intensive development of the site are effectively mitigated through the use of special architectural, landscaping, site planning and urban design elements incorporated into the overall development of the site creating a high standard of appearance and which integrate, to the extent possible, the site with the adjacent NAIT Campus.
All uses shall be designed as integral components of the NAIT Campus and, as such, shall be primarily oriented to serve the educational needs of NAIT students. Professional, Financial and Office Support Services, Minor and Major Eating and Drinking Establishments, Personal Service Shops, Business Support Services, Convenience Retail Stores, and Health Services shall not be located in a free standing structure separate from a structure containing residential or institutional/educational uses
The Development Officer, in consultation with the Transportation and Streets Department, may require a Traffic Impact Assessment with an application for a Development Permit. Vehicular access and egress to and from the site shall be to the satisfaction of the Transportation and Streets Department.
Child Care Services shall be developed in accordance with Section 93 of the Land Use Bylaw.
Signs shall be allowed in this District, at the discretion of the Development Officer, in accordance with Schedule 79E and the general provisions of Sections 79.1 to 79.9, inclusive, of the Land Use Bylaw. Notwithstanding Schedule 79E of the Land Use Bylaw, signs allowed by this schedule shall only be used to identify buildings, services, events, venues and parking areas associated with the NAIT Campus and directions thereto. Also, signs shall be designed, integrated and located on the site and buildings in a manner that does not detract from the overall quality of appearance of the site and shall be compatible with the architectural character of the surrounding buildings. No portable signs shall be allowed adjacent to Princess Elizabeth Avenue, 106 Street and 118 Avenue.
