DC2.643.1.          General Purpose

To accommodate the development of ”Area A” and ”Area B”, as shown on Schedule ”C” Map of this Bylaw, as a part of a shopping centre with site specific development regulations designed to ensure that it is compatible with the scale and use of neighbouring park and school development by mitigating potential use and traffic conflicts. Area A and Area B together create a comprehensive planned shopping centre with shared parking between the two separately titled parcels.

Area A

DC2.643.2.          Area of Application

Lot 1, Block 3, Plan 002 2276 shown as ”Area A” on Schedule "A" Map of this bylaw, adopting this provision.

DC2.643.3.          Uses

  1. Bars and Neighbourhood Pubs as an accessory use to a Restaurant use in Building C only, for less than  156 occupants and  190 m² of Public Space

  2. Business Support Services, up to a maximum Floor Area of 465 m²

  3. Convenience Retail Stores, up to a maximum Floor Area of 465 m²

  4. Drive-in Food Services, up to a maximum Floor Area of 465 m²

  5. Gas Bars, up to a maximum Floor Area of 465 m²

  6. General Retail Stores, up to a maximum Floor Area of 4,180m²

  7. Health Services, up to a maximum Floor Area of 465 m²

  8. Indoor Participant Recreation Services, up to a maximum Floor Area of 465 m²

  9. Major Amusement Establishment as an accessory use to a Restaurant use in Building C only

  10. Minor Service Stations, up to a maximum Floor Area of 465 m²

  11. Personal Service Shops, up to a maximum Floor Area of 465 m²

  12. Professional, Financial, and Office Support Services, up to a maximum Floor Area of 465 m²

  13. Restaurants, for less than  144 occupants and  175 m² of Public Space

  14. Specialty Food Services, for less than 100 occupants and 120 m² of Public Space

  15. Warehouse Sales, up to a maximum Floor Area of 930 m²

  16. Fascia On-premises Signs

  17. Freestanding On-premises Signs

  18. Projecting On-premises Signs

  19. Temporary On-premises Signs

DC2.643.4.          Development Regulations

  1. Development shall reflect the design concept and type of development illustrated by the Site Plan, as shown on Appendix I of this Bylaw.

  2. The total floor area of any combination of Drive-in Food Services, Restaurants, or Specialty Food Services shall not exceed 2255 m2 or 50% of the total floor area for Area A.

  3. The Site shall not have more than one General Retail Store Use over the size of  1,858 m².

  4. The maximum Floor Area Ratio shall be 0.4.

  5. A minimum landscaped Yard of 6.0 m shall be required where the Site abuts a public roadway.

  6. The maximum building Height shall be 2 storeys and 12.0 m, inclusive of mechanical facilities and screening of same.

  7. All development shall be constructed using a similar or compatible architectural theme. An exception may be made to this general requirement where the function of an individual business dictates a specific style or image associated with a company. In such cases, the development shall maintain harmony in terms of overall project design and appearance.

  8. All mechanical equipment on the roof of any building shall be completely screened or incorporated in the roof envelope.

  9. No parking, loading, storage, trash collection, outdoor service, or display area shall be permitted within a required Yard. Parking, loading, and trash collection areas shall be located and screened from view from adjacent sites and public roadways in accordance with the provisions of subsection 55.4 of the Zoning Bylaw.

  10. Parking shall be provided in accordance with Section 54 of the Zoning Bylaw. 

  11. All Uses shall be part of a purpose-designed shopping centre.

  12. Signs shall comply with the regulations found in Schedule 59E of the Zoning Bylaw, and a comprehensive Sign Design Plan, consistent with the overall intent of subsection 59.3 of the Zoning Bylaw, shall be prepared for the development and submitted with the development application, to be approved by the Development Officer.

  13. Landscaping shall be provided in accordance with Section 55 of the Zoning Bylaw. The following additional landscaping requirements shall also be provided:

  1. Boulevard trees along the abutting roadway frontage of 42 Street and 139 Avenue;

  2. Yards at the rear of buildings that back on to 42 Street and 139 Avenue will be landscaped to a standard of 2 trees per 25 m² and 4 shrubs per 15 m²; and

  3. All other Yards shall be landscaped to a standard of 1.5 trees per 25 m² and 3 shrubs per 15 m².

Area B

DC2.643.2.        Uses

  1. Bars and Neighbourhood Pubs as an accessory use to a Restaurant use in Building F only, for less than 75 occupants and 90 m2 of Public Space

  2. Business Support Services, up to a maximum Floor Area of 465 m²

  3. Convenience Retail Stores, up to a maximum Floor Area of 465 m²

  4. Drive-in Food Services, up to a maximum Floor Area of 465 m²

  5. Gas Bars, up to a maximum Floor Area of 465 m²

  6. General Retail Stores, up to a maximum Floor Area of 4,180 m²

  7. Health Services, up to a maximum Floor Area of 465 m²

  8. Indoor Participant Recreation Services, up to a maximum Floor Area of 465 m²

  9. Minor Service Stations, up to a maximum Floor Area of 465 m²

  10. Major Amusement Establishment as an accessory use to a Restaurant use in Building F only

  11. Personal Service Shops, up to a maximum Floor Area of 465 m²

  13. Restaurants, for less than 275 occupants and  330 m² of Public Space

  14. Specialty Food Services, for less than 100 occupants and 120 m² of Public Space

  17. Freestanding On-premises Signs

  18. Projecting On-premises Signs

  19. Temporary On-premises Signs

DC2.643.3.          Development Regulations

  3. The Site shall not have more than three General Retail Store Use over the size of 1,858 m², and all such uses shall be restricted to Building G.

  4. The maximum Floor Area Ratio shall be 0.4.

  5. A minimum landscaped Yard of 6.0 m shall be required where the Site abuts a public roadway.

  6. The maximum building Height shall be 2 storeys and 12.0 m, inclusive of mechanical facilities and screening of same.
