(DC2) SITE SPECIFIC DEVELOPMENT CONTROL PROVISION

DC2.727.1.        General Purpose

The purpose of this provision is to provide for an area of public land for active and passive recreational uses; stormwater management; the conservation of Natural Area (SE 132) within the site; and to allow for remediation of the contaminated portions within the site.

DC2.727.2.        Area of Application

This Provision shall apply to SW¼ 25-51-24-W4, containing 56 hectares, more or less, located at the northeast corner of the intersection of Ellerslie Road (9 Avenue SW) and 50 Street SW, as shown on Schedule ”A” of the Bylaw adopting this Provision.

 

For general purposes, the site area will consist of the following two areas, generally as shown in Appendix 1:

Within Area A and Area B

  1. Carnivals, for periods not exceeding four days

  2. Child Care Services

  3. Community Recreation Services

  4. Indoor Participant Recreation Services

  5. Outdoor Participant Recreation Services

  6. Public Park

  7. Public Libraries and Cultural Exhibits

  8. Spectator Entertainment Establishments

  9. Spectator Sports Establishments

  10. Private Clubs

  11. Restaurants, when designed as an integral and accessory component of Community Recreation Services, Indoor Participant Recreation Services, Natural Science Exhibits, Public Libraries and Cultural Exhibits, Spectator Entertainment

  12. Establishments, Spectator Sports Establishments, or Private Clubs.  This may include temporary food services, including but not limited to beer gardens and mobile food services, at the discretion of the Development Officer.

  13. Specialty Foods Services, when designed as an integral and accessory component of Community Recreation Services, Indoor Participant Recreation Services, Natural Science Exhibits, Public Libraries and Cultural Exhibits, Spectator Entertainment Establishments, Spectator Sports Establishments, or Private Clubs. This may include temporary food services, including but not limited to beer gardens and mobile food services, at the discretion of the Development Officer.

DC2.727.4.        Development Regulations

Within Area A

  1. The Developer shall comply with the regulations regarding roadway improvements as listed in Appendix 2.

  2. The minimum Yard along 50 Street shall be 6.0 m.

  3. The minimum Yard along the Transportation and Utility Corridor shall be 4.5 m.

  4. The minimum Yard along the Eastern boundary shall be 7.5 m.

  5. The minimum Yard along Ellerslie Road shall be 4.5 m.

  6. Where it is unreasonable for a development to comply with clause (1), (2), (3), or (4) because of characteristics fundamental to the provision of infrastructure services or roadways, the Development Officer may relax requirements of clause (1), (2), (3) or (4).

  7. The maximum building Height shall be 17.0 m.

  8. Signs shall comply with the regulations in Schedule 59C, except for signs in Natural Area SE 132, which shall comply with regulations in Schedule 59K.

  9. Natural Area SE 132 shall comply with Section 531.4 of the Zoning Bylaw.

  10. The Development Officer shall ensure that the following studies have been completed and approved prior to issuance of a Development Permit: Historical Resources Overview, Natural Site Assessment Stage 1, Natural Site Assessment Stage 2, and Natural Area Management Plan.

Within Area B

  1. The maximum building Height shall be 17.0 m.

  2. Signs shall comply with the regulations in Schedule 59C.

  3. The Development Officer shall ensure that the Historical Resources Overview has been completed and approved prior to issuance of a Development Permit.

  4. The Development Officer shall require, as a condition of approval, that the following requirements are fulfilled:

  1. a remediation report under seal from an engineer confirming that an acceptable level of remediation has been completed and has been approved by the City, in consultation with Alberta Environment and the Capital Health Authority, for all allowable Uses outlined in subsection 3;

  2. evidence in the form of a letter from the Planning and Development Department of the City, the Capital Health Authority and Alberta Environment that the work has passed final inspection and meets all applicable City bylaw requirements including development, zoning, building and occupancy requirements and all safety codes and regulatory requirements as set out by Alberta Environment and the Capital Health Authority.

APPENDIX 2

Roadway Improvement Development Regulations for AREA A:

 

  1. The owner shall enter into an Agreement for off-site improvements necessary to serve the development. The Agreement process includes an engineering drawing review and approval process.  Improvements to be addressed in the Agreement include but are not limited to the following:

  1. Funding of Arterial Road construction must be provided toward 50 Street improvements from Anthony Henday Drive to the access at 50 Street.

  2. Removal of all existing accesses to 50 Street and Ellerslie Road along property frontage to the satisfaction of the Transportation Department.

  3. An all-directional access to 50 Street including curb ramps on both sides.  The access must be centered on the property line with the adjacent lands to the south and west and must extend east into the site.

  4. An all-directional access to Ellerslie Road including curb ramps on both sides located approximately 125 m from the east property line.

  5. A 2.1 m x 9 m Transit Pad with a 2 m  x 3 m  Shelter Pad located on the east side of 50 Street, approximately 25 m north of the access.

  6. A 2.1 m x 9 m Transit Pad with a 2 m x 3 m Shelter Pad located on the north side of Ellerslie Road, approximately 25 m east of the west curb line.

  7. A northbound right turn bay and a southbound left turn bay to the all-directional access on 50 Street.

  8. A westbound right turn bay and an eastbound left turn bay to the all-directional access on Ellerslie Road.

  1. A road plan must be registered to provide any additional road right-of-way for 50 Street and Ellerslie Road, including right and left turn bays. The property dedication must conform to an approved concept plan or to the discretion of the Transportation Department.

  2. Parking will not be permitted along the ”throat” of the site accesses at both 50 Street and at Ellerslie Road.

  3. Garbage enclosures must be located entirely within private property and gates and/or doors of the garbage enclosure must not open or encroach into road right-of-way.
