(DC2) SITE SPECIFIC DEVELOPMENT CONTROL PROVISION

DC2.829.1.       General Purpose

The purpose is to provide for industrial businesses that carry out their operations such that no nuisance is created or apparent outside an enclosed building while ensuring compatibility with adjacent zone, environmental remediation is undertaken, and to accommodate limited compatible non-industrial businesses.

DC2.829.2.      Area of Application

This Provision shall apply to Lot A, Block 19, Plan 3256HW, located at 10805 – 120 Street NW, Queen Mary Park, as shown on Schedule “A” appended to the Bylaw adopting this provision.

  1. Animal Hospitals and Shelters 

  2. Bars and Neighbourhood Pubs

  3. Business Support Services

  4. Commercial Schools

  5. Convenience Retail Stores

  6. Creation and Production Establishments

  7. Equipment Rentals, provided that all equipment and goods for rent are contained within an enclosed building

  8. Funeral, Cremation and Interment Services

  9. Gas Bars

  10. Greenhouses, Plant Nurseries and Market Gardens

  11. General Industrial Uses

  12. Health Services

  13. Indoor Participant Recreation Services

  14. Limited Contractor Services

  15. Major Alcohol Sales

  16. Minor Amusement Establishments

  17. Minor Alcohol Sales

  18. Media Studios

  19. Mobile Catering Food Services

  20. Nightclubs

  21. Outdoor Participant Recreation Services

  22. Personal Service Shops 

  23. Private Clubs

  24. Professional, Financial and Office Support Services

  25. Religious Assembly, excluding rectories, manses, dormitories, convents, monasteries and other residential buildings

DC2.829.4.        Development Regulations

  1. Notwithstanding Section 720.3 (2) of the Zoning Bylaw, no Site Plan is appended to this Provision.

  2. The minimum Site Frontage shall be 30.0 m, unless access is provided from a service road.

  3. The maximum Floor Area Ratio shall be 1.2.

  4. A minimum Setback of 6.0 m shall be required where any lot line of a Site abuts a public roadway, other than a Lane, or abuts the property line of a Site zoned residential.

  5. No parking, loading, storage, trash collection, outdoor service or display area shall be permitted within a Setback.

  6. The maximum Height shall not exceed 12.0 m

  7. Notwithstanding section 3(f) of this Zone, for a building housing a General Industrial Use where it is required to facilitate the industrial development of the Use, the maximum Height shall not exceed 14.0 m,

  8. Bars and Neighbourhood Pubs, Nightclubs, and Restaurants that are adjacent to or across the lane from a Residential Use shall be limited to less than 200 occupants and 240 m2 of Public Space.

  9. Signs shall comply with the regulations found in Schedule 59F.

DC2.829.5.         Additional Development Regulations

  1. The minimum Floor Area for a Warehouse Sales establishment shall not be less than 1000 m2 unless at least 50% of the Floor Area of the establishment is used for warehousing or storage of the goods sold or distributed from the establishment.

  2. Notwithstanding section 3(i) of this Zone, Fascia Off-premises Signs, Freestanding Off-premises Signs, Major Digital Signs, Minor Digital On-premises Signs, Minor Digital Off-premises Signs, Minor Digital On-premises Off-premises Signs, and Roof On-premises Signs shall comply with the regulations found in Schedule 59F.3.

DC2.829.6.       Environmental

  1. Prior to the issuance of a Development Permit, the applicant and/or owner shall provide to the satisfaction of the Development Officer and the Environmental Planning Group in consultation with Alberta Environment and Sustainable Resource Development and Alberta Health Services that the lands have been remediated to allow for the intended use. Remediation shall include a vapour management program that monitors the stack and indoor air quality to be reported quarterly until deemed satisfactory by Transportation Services, Alberta Environment and Sustainable Resource Development, and Alberta Health Services. Frequency of reporting will be evaluated annually, if needed, by the above agencies.
