DC2.862.1.       General Purpose

To establish a Site Specific Development Control Provision to accommodate a range of commercial and business uses that will ensure compatibility with nearby heavy industrial land uses.

DC2.862.2.       Area of Application

This Provision shall apply to Lot 15, Block 91, Plan 132 1501, as shown on Schedule "A" of this bylaw adopting this Provision, Gold Bar.

DC2.862.3.       Uses

Uses shall be restricted in general accordance with the specific areas identified as Illustrated in Appendix I:

Area A

  1. Automotive and Equipment Repair Shops

  2. Automotive/Minor Recreation Vehicle Sales/Rentals

  3. Bars and Neighbourhood Pubs, for less than 200 occupants and 240 m2 of Public Space

  4. Business Support Services

  5. Commercial Schools

  6. Convenience Retail Stores

  7. Creation and Production Establishments

  8. Drive-in Food Services

  9. Equipment Rentals, provided that all equipment and goods for rent are contained within an enclosed building

  10. Gas Bars

  11. General Retail Stores

  12. Government Services

  13. Health Services

  14. Household Repair Services

  15. Indoor Participant Recreation Services

  16. Limited Contractor Services

DC2.862.4.       Development Regulations for Areas A, B and C

  1. The minimum Site Frontage shall be 30.0 m unless access is provided from a service road.

  2. The maximum Floor Area Ratio shall be 3.5.

  3. A minimum Setback of 4.5 m shall be required where a Site abuts a public roadway, other than a Lane.

  4. The minimum Setback of 6.0 m shall be required where the Rear or Side Lot Line of a Site abuts the Lot Line of a Residential Zone.

  5. The maximum building Height shall not exceed 14.0 m nor four (4) Storeys.

  6. Loading, storage, trash collection, and Accessory storage areas shall be located to the rear or sides of the principal building and shall be screened from view from any adjacent Sites, or public roadways in accordance with the provisions of subsection 55.4 of the Zoning Bylaw. If the rear or sides of a Site are used for parking or an outdoor service or display area and abut a Residential Zone or a Lane serving a Residential Zone, such areas shall be screened in accordance with the provisions of subsection 55.4 of the Zoning Bylaw.

  7. No parking, loading, storage, trash collection, outdoor service or display area shall be permitted within a Setback area.

  8. Any business premises or multiple occupancy building having a Floor Area greater than 3000 m2 or a single wall length greater than 25.0 m visible from a public road, shall comply with the following criteria:

  9. theroof line and building façade shall include design elements that reduce the perceived mass of the building and add architectural interest; and

  10. landscaping adjacent to exterior walls shall be used to minimize the perceived mass of the building and to create visual interest.

  11. All mechanical equipment, including roof mechanical units, shall be concealed by screening in a manner compatible with the architectural character of the building or concealed by incorporating it within the building.

  12. Signs shall comply with the regulations found in Schedule 59F.

  13. A detailed Landscaping Plan completed by a qualified landscape professional, and to the satisfaction of the development officer, shall be submitted in accordance with Section 55 of the Zoning Bylaw, prior to the approval of any development permit.
