DC2.879.1        General Purpose

To establish a Site Specific Development Control Provision for highway commercial uses along 100 Avenue such that they do not adversely affect the La Perle residential area to the south.

DC2.879.2        Area of Application

This DC2 Provision shall apply to Lot 11, Block 1, Plan 132 4378, as shown on Schedule "A" attached to the Bylaw adopting this Provision, Place La Rue.

DC2.879.4.       Development Criteria

  1. Notwithstanding Section 720.3(2), no Site Plan is appended to this provision.

  2. The minimum Site Frontage shall be 30.0 m.

  3. The maximum Floor Area Ratio shall be 1.5.

  4. A minimum Setback of 7.5 m shall be required where a Site abuts a public roadway including a Lane that serves a Residential Zone, or where a Site abuts the lot line of a Site zoned Residential.

  5. No parking, loading, trash collection, outdoor service or display area shall be permitted within a Setback. Loading, storage and trash collection areas shall be located to the rear or sides of the principal building and shall be screened from view from any adjacent Sites, public roadways or Light Rail Transit lines in accordance with the provisions of subsection 55.4 of the Zoning Bylaw. If the rear or sides of a Site are used for parking, an outdoor service or display area or both, and abut a Residential Zone or a Lane serving a Residential Zone, such areas shall be screened in accordance with the provision of subsection 55.4 of the Zoning Bylaw.

  6. The maximum Building Height shall be 14.0 m.

  7. Any business premises or multiple occupancy building having a Floor Area of 3,000 m2 or a single wall length greater than 25.0 m visible from a public road shall comply with the following:

  1. The roof line and the building façade shall include design elements that reduce the perceived mass of the building; and

  2. Landscaping adjacent to exterior walls shall be used to reduce the perceived mass of the building and provide visual interest.

  1. All mechanical equipment, including roof mechanical units, shall be screed in a manner compatible with the architectural character of the building or concealed by incorporating it within the building.

  2. All loading docks on buildings visible from 100 Avenue shall not be located on the south facing side of such buildings.

  3. All storage, display and parking areas shall be Hardsurfaced in accordance with subsection 54.6(1) of the Zoning Bylaw.

  4. All outdoor and display lighting shall be directed onto the Site and not extend south of the south property line. Light fixtures and apparatus shall not exceed 10m (32 feet) in Height.

  5. All exposed building faces shall have consistent and harmonious exterior finishing materials.

  6. No outside acoustical, such as paging and/or loudspeakers, devices shall be permitted.

  7. A comprehensive sign design plan shall be submitted and signs shall be allowed in this Provision as provided for in Section 59F of the Edmonton Zoning Bylaw 12800.

  8. Freestanding On-premises Signs, Major Digital Signs, Minor Digital Off-premises Signs, Minor Digital On-premises Signs, and Minor Digital On-premises Off-premises Signs shall not exceed 8 metres (26 feet) in Height along 100 Avenue and shall be perpendicular to the major roadways.

  9. Any signage developed on a south-facing wall above 10m in Height or attached to any building above 10m in Height that abuts 100 Avenue is to be backlit and designed to prevent light from emitting towards residential areas south of 100 Avenue.

  10. Notwithstanding any other provisions of the Edmonton Zoning Bylaw 12800, individual business identification signs located on the facades of buildings shall be similar in proportion, construction materials and placement. The Signs shall be designed and located so as to ensure that signage does not detract from the overall appearance of the development and is not obtrusive, having regards to the scale of the buildings on the Site and to the distance of the building Setback.

DC2.879.5.       Additional Development Regulations for Uses

  1. Health Services will only be developed in Area B (Lot 2 on subdivision approval LDA13-0294), and shown on Appendix I.

  2. Convenience Retail Stores, Convenience Vehicle Rentals and Personal Service Shops shall be developed only as accessory uses to a Professional, Financial and Office Support Service, Motel, Hotel, Gas Bar, or, a Minor or Major Service Station use.

  3. Major Eating and Drinking Establishments shall only be developed as an accessory use to a Hotel or Motel use.

  4. Indoor Participant Recreation Services shall only be developed as an accessory use to a Hotel, Motel or to a Professional, Financial, and Office Support Service use.

  5. The following regulations shall apply to Convenience Vehicle Rentals developments:

  1. all storage, display or parking areas shall be Hardsurfaced in accordance with subsection 54.6(1) of the Zoning Bylaw;

  2. all display areas that abut a Residential Zone or a Lane serving a Residential Zone shall be screened in accordance with the provisions of subsection 55.4 of the Zoning Bylaw; and

  3. lighting for the display areas shall be mounted on lamp standards and no exposed bulbs or strings of lights shall be used.
