DC2.893.1.        General Purpose

To establish a Site Specific Development Control Provision to accommodate a phased shopping centre development anchored by a grocery store, that is sensitive in scale and contributes positively to the surrounding neighbourhood.

DC2.893.2         Area of Application

This Provision shall apply to Lot 140, Block 1, Plan 1025888; located at 403 McConachie Way NW, as shown on Schedule “A” of this Bylaw adopting this Provision, McConachie.

DC2.893.4        Development Regulations

4.1   General

  1. Development shall be in general conformance with Appendix I. Appendix I indicates development phasing, where future commercial / retail uses may be developed in the area designated ‘Future Commercial / Retail Development’. Should a gas bar be developed in the future, it shall be located in the general location as indicated on Appendix I.

  2. Accessory Parking is permitted in the area designated as ‘Future Commercial / Retail Development’ on Appendix I until such time as development occurs.

  3. The maximum Floor Area Ratio shall be 1.0.

  4. A minimum Setback of 4.0m shall be required where a Site abuts a public roadway, other than a Lane.

  5. A minimum Setback of 3.5m from buildings and parking shall be required where a Site abuts the property line of a Site in a Residential Zone.

  6. The maximum building Height shall be 11.0 m.

  7. All Facades fronting a public roadway shall be architecturally treated to create unified building exteriors.

  8. The Maximum Floor Area of any individual business premises shall be 3200m2.

  9. The owner shall submit a Crime Prevention Through Environmental Design (CPTED) Assessment that shall be reviewed and accepted by the Development Officer prior to the issuance of a Development Permit to ensure that the development on the Site provides a safe urban environment in accordance with the guidelines and principles established in the Design Guide for a Safer City.

  10. All mechanical equipment, including roof mechanical units, shall be concealed by screening in a manner compatible with the architectural character of the building or concealed by incorporating it within the building. 

  11. Signs shall comply with the regulations found in Schedule 59E and in accordance with the regulations of this bylaw.

  12. The Maximum Floor Area of Major Alcohol Sale shall be 540m2.

  13. Restaurants shall be for less than 200 occupants and 240m2 of Public Space.

  14. Specialty Food Stores shall be for less than 100 occupants and 120m2 of Public Space.

  15. Bars and Neighbourhood Pubs shall be for less than 100 occupants and 120 sq m of public space.

4.2     Parking, Loading and Access

  1. Vehicular access shall be in general accordance with Appendix I, to the satisfaction of the Development Officer in consultation with Transportation Services.

  2. No parking, loading, storage, trash collection, outdoor service or display area shall be permitted within a Setback.  Loading, storage and trash collection areas shall be located to the rear or sides of the principal building and shall be screened from view from any adjacent Sites or public roadways, in accordance with this bylaw. If the rear or sides of the Site are used for parking, an outdoor service or display area, or both, and abut a Residential Zone or a Lane serving a Residential Zone, such areas shall be screened in accordance with the provisions of subsection 55.4 of this Bylaw. 

  3. Bicycle parking shall be developed in accordance with this bylaw.

  4. Parking shall be provided on Site in accordance with this bylaw.

4.3     Landscaping

  1. Landscaping shall be provided in accordance with this bylaw.

  2. Notwithstanding 4.3a, where a Site abuts the property line of a Site in a Residential Zone, the required Setback shall be landscaped at 1.5 times the requirement of this bylaw.

  3. Landscaping on the Site shall include the use of plant materials that provide colour throughout the year to enhance the appearance of the development during the cold weather months.
