DC2.990.1.            General Purpose

The purpose of this zone is to provide for a range of commercial and business uses on a site that maintains high visibility along 97 Street and Yellowhead Trail, and to establish site-specific development regulations to ensure that the Site is remediated to the extent necessary to accommodate the intended Uses.

DC2.990.2.           Area of Application

This Provision shall apply to the lands legally described as Lot 1, Block 1, Plan 0826005 as shown on Schedule “A” of the Bylaw, adopting this Provision, Yellowhead Corridor West.

DC2.990.4.         Development Regulations

  1. Notwithstanding section 720.3 (2) a site plan is not appended to this Provision.

  2. The maximum Floor Area Ratio shall be 3.5.

  3. The maximum building Height shall not exceed 16.0 m.

  4. A minimum Setback of 4.5 m shall be required from all property lines Abutting 97 Street NW and Yellowhead Trail NW.

  5. A minimum Setback of 3.0 m shall be from all other property lines.

  6. No parking, loading, storage, trash collection, outdoor service areas shall be permitted within a Setback. Loading, storage and trash collection areas shall be located to the rear or sides of the principal building and shall be screened from 97 Street NW and Yellowhead Trail NW.

  7. Any building having a Floor Area greater than 3000m2 or a single wall length greater than 25.0 m visible from a public roadway, shall comply with the following criteria:

  1. The roofline and building façade shall include design elements that reduce the perceived mass of the building and add architectural interest; and

  2. Landscaping adjacent to exterior walls shall be installed to minimize the perceived mass of the building and to create visual interest.

  1. All mechanical equipment, including roof mechanical units, shall be concealed by screening in a manner compatible with the architectural character of the building or concealed by incorporating it within the building, to the satisfaction of the Development Officer.

  2. All equipment and goods for rent as part of an Equipment Rental Use shall be contained within an enclosed building.

  3. Bars and Neighbourhood Pubs shall be less than 200 occupants and 240m2 of Public Space.

  4. Restaurants shall be less than 200 occupants and 240m2 of Public Space.

  5. Specialty Food Services shall be less than 100 occupants and 120m2 of Public Space.

  6. Signs shall comply with the Zoning Bylaw Schedule 59F.

  7. The following regulations shall apply to Automotive and Minor Recreational Vehicle Sales/Rentals, Convenience Vehicle Rentals and Truck and Mobile Home Sales/Rentals developments:

  1. all storage, display and parking areas shall be hardsurfaced in accordance with The Zoning Bylaw;

  2. lighting for the display areas shall be mounted on lamp standards and no exposed bulbs or strings of lights shall be used.

  1. Urban Indoor Farms shall comply with the Zoning Bylaw.

  2. Landscaping shall comply with the Zoning Bylaw

  3. A Crime Prevention Through Environmental Design Assessment shall be provided to the satisfaction of the Development Officer to ensure that the development provides a safe urban environment in accordance with the guidelines and principles established in the Design Guide for a Safer City (City of Edmonton, 1995) in accordance with the Zoning Bylaw.

  4. Prior to the issuance of a Development Permit, except for a Development Permit for demolition, excavation, shoring or signage, the Development Officer shall require the applicant to submit Environmental Site Assessments (ESAs), including but not limited to additional Phase II ESAs, and a Remedial Action Plan to ensure the Site is suitable for the full range of uses contemplated in the Development Permit application.   Upon issuance of the Development Permit, the Development Officer shall impose any conditions necessary to ensure the Site is suitable for the full range of uses contemplated in the Development Permit, application, including but limited to requiring the Site to be remediated and owner to submit a Remediation Report, to the satisfaction of the Development Officer.
