Amendment No.514
WHEREAS Lot 9, Block 4, Plan 646NY, located south of 77 Avenue east of 75 Street, King Edward Park, Edmonton, Alberta, is specified on the Zoning Map as (IM) Medium Industrial Zone; and
WHEREAS an application was made to rezone the above described property to (DC2) Site Specific Development Control Provision;
NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:
1. The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as Lot 9, Block 4, Plan 646NY,located south of 77 Avenue east of 75 Street, King Edward Park,Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule ”A”, from (IM) Medium Industrial Zone to (DC2) Site Specific Development Control Provision.
2. The uses and regulations of the aforementioned DC2 Provision are annexed hereto as Schedule "B".
3. The sketch plan annexed hereto as Schedule ”A” and the uses and regulations of the DC2 Provision shown on Schedule ”B” annexed hereto are hereby incorporated into the Zoning Bylaw, being Part IV to Bylaw 12800, The Edmonton Zoning Bylaw.


Schedule ”B”
To establish a Site Specific Development Control Provision to accommodate a limited range of commercial uses, with site development regulations that will ensure compatibility with current and future adjacent land uses and roadways.
This provision shall apply to Lot 9, Block 4, Plan 646NY, located at 7650 – 75 Street, King Edward Park.

The site layout and building location shall be generally in accordance with the site plan as illustrated in Appendix I of this Bylaw.
The facades of the buildings shall be generally in accordance with the elevations as illustrated in Appendix II of this Bylaw.
The maximum Floor Area Ratio shall be 0.6.
The maximum Building Height shall be 12.0 m.
Parking and loading shall be in accordance with the Site Plan (Appendix I).
Access to the site shall be off 77 Avenue and the adjacent lane only.
Landscaping shall be:
In accordance with the Site Plan ( Appendix I);
A minimum landscaped yard of 3.0 m shall be required where the Site abuts the 75 Street and 77 Avenue; and
Landscaping shall be in accordance with Section 55 of the Zoning Bylaw.
Trash collection areas shall be located at the rear of the principal building and shall be screened from view from any adjacent Sites and public roadways.
All mechanical equipment, including roof mechanical units, shall be concealed by screening in a manner compatible with the architectural character of the building or concealed by incorporating it within the building.
Signs shall comply with Schedule 59E of the Zoning Bylaw.
The following regulations shall apply to Rapid Drive-through Vehicle Services developments:
the total number of bays shall not exceed two;
a minimum of five in-bound and one out-bound queuing spaces shall be provided for each service bay;
all queuing spaces shall be a minimum of 6.5 m long and 3.0 m wide. Queuing lanes shall provide sufficient space for turning and manoeuvring;
all storage shall be located inside the building envelope;
the design, finishing and siting of such development shall achieve a compatible relationship with surrounding development and a high standard of appearance when viewed from adjacent roadways;
all operations and mechanical equipment associated with this Use Class shall be located within an enclosed building;
all drive isles or parking areas shall be hard surfaced; and
the owner shall enter into a Municipal Improvement Agreement for the paving of the adjacent public lane.
Prior to issuance of any Development Permit anywhere on the site, the applicant shall show to the satisfaction of the Development Officer, in consultation with the Capital Health Authority and Alberta Environment, that the site is suitable for the full range of allowable uses.
