WHEREAS Lot 6, Block 12, Plan 042 0752; located north of 49 Avenue NW and west of 116A Street NW, Malmo Plains, Edmonton, Alberta, is specified on the Zoning Map as (AJ) Alternative Jurisdiction Zone; and
WHEREAS an application was made to rezone the above described property to (DC2) Site Specific Development Control Provision;
NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:
1. The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as Lot 6, Block 12, Plan 042 0752; located north of 49 Avenue NW and west of 116A Street NW, Malmo Plains, Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule ”A”, from (AJ) Alternative Jurisdiction Zone to (DC2) Site Specific Development Control Provision.
2. The uses and regulations of the aforementioned DC2 Provision are annexed hereto as Schedule "B".
3. The sketch plan annexed hereto as Schedule ”A” and the uses and regulations of the DC2 Provision shown on Schedule ”B” annexed hereto are hereby incorporated into the Zoning Bylaw, being Part IV to Bylaw 12800, The Edmonton Zoning Bylaw.

(DC2) SITE SPECIFIC DEVELOPMENT CONTROL PROVISION
To establish a Site Specific Development Control provision to accommodate low and high density residential housing types that include Extended Medical Treatment Services and residences for seniors, including designated assisted living, to ensure compatibility with surrounding land uses and a high quality of appearance.
This DC2 Provision shall apply to Lot 6, Block 12, Plan 0420752; located between 49 Avenue and 51 Street, and 117 Street, and east of 118 Street, as shown on Schedule ’A’ annexed to the Bylaw adopting this DC2 Provision.

The site layout and building location shall be substantially in accordance with the Site (A001) and Landscaping (L001) Plans as illustrated in Appendices I & II respectively, and the aerial view concept, Appendix III.
The maximum number of units shall be Two Hundred and Fifty (250).
The maximum total site coverage shall not exceed 50%.
The minimum Front Yard shall be 6.0 m where the site abuts 49th Avenue and 51st Avenue for all housing uses, except Apartment Housing, Boarding and Lodging Housing, Extended Medical Treatment Services and Health Services which shall be 9.0 m.
The minimum Side Yard shall be 1.2 m for all housing uses except for Apartment Housing, Boarding and Lodging Housing, Extended Medical Treatment Services and Health Services. The minimum Side Yard for Apartment Housing, Boarding and Lodging Housing shall be 9.0 m.
The maximum building height shall not exceed 45 metres nor 16 storeys.
Vehicular parking shall comply with the regulations found in Schedule 54 and as illustrated in Appendix I.
A minimum Amenity Area of 7.5 m2 per Dwelling shall be provided.
Signs shall comply with the regulations found in Schedule 59B of the Zoning Bylaw.
All exterior finishing materials must be of good quality, durable, attractive in appearance and with consistent treatment on all faces of the buildings.
To ensure that a high standard of appearance and a sensitive transition to the surrounding land uses are achieved, a detailed landscaping plan (Appendix 2) for the entire site shall be submitted to and approved by the Development Officer. These plans shall include details of pavement materials, exterior lighting, sizes and species of new plantings for the entire site.
