A Bylaw to amend Bylaw 12800, as amended,

The Edmonton Zoning Bylaw

Amendment No. 624

WHEREAS Block X, Plan 1522 AS, located at 8627 - 91 Street, Bonnie Doon, Edmonton, Alberta, is specified on the Zoning Map as (DC2) Site Specific Development Control Provision; and

WHEREAS an application was made to rezone the above described property to (DC2) Site Specific Development Control Provision;

NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:

1.      The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as Block X, Plan 1522 AS, located at 8627 - 91 Street, Bonnie Doon, Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule ”A”, from (DC2) Site Specific Development Control Provision to (DC2) Site Specific Development Control Provision.

2.      The uses and regulations of the aforementioned DC2 Provision are annexed hereto as Schedule "B".

3.      The sketch plan annexed hereto as Schedule ”A” and the uses and regulations of the DC2 Provision shown on Schedule ”B” annexed hereto are hereby incorporated into the Zoning Bylaw, being Part IV to Bylaw 12800, The Edmonton Zoning Bylaw.

(DC2) SITE SPECIFIC DEVELOPMENT CONTROL PROVISION

1.       General Purpose

To establish a Provision for a cultural centre (La Cite Francophone) that allows for selected commercial, educational, health, office and administrative uses that complement the concept of a cultural centre.

2.       Area of Application

Block X, Plan 1522 AS, located on the east side of 91 Street south of the east/west laneway south of 86 Avenue as shown on Schedule ”A” appended to the Bylaw adopting this provision, Bonnie Doon

3.       Uses

  1. Business Support Services

  2. Child Care Services

  3. Commercial Schools

  4. Community Recreation Services

  5. Convenience Retail Stores

  6. General Retail Stores

  7. Health Services

  8. Indoor Participant Recreation Services

  9. Minor Amusement Establishments

  10. Personal Service Shops

  11. Professional, Financial and Office Support Services

  12. Public and Private Education Services

  13. Public Libraries and Cultural Exhibits

  14. Restaurants, for less than 100 occupants and 120 m2 of public space

  15. Specialty Food Services

  16. Spectator Entertainment Establishments

  17. Fascia On-premises Signs

  18. Freestanding On-premises Signs

  19. Projecting On-premises Signs

4.       Development Regulations

  1. The overall site development shall be generally in accordance with the site development plan attached as Appendix I; with the elevations attached as Appendix II;  and with the site calculations attached as Appendix III.

  2. The maximum height of development shall be 15.5 m.

  3. The maximum Floor Area Ratio shall be 1.5.

  4. Development in this Provision shall comply with Sections 510.4 and 510.5 of the Zoning Bylaw, except as otherwise stated in this section.

  5. The minimum number of on-site parking stalls shall be 167.

  6. Signs shall be developed in accordance with Section 59.C of the Zoning Bylaw, except that the number of Free-standing Signs shall be limited to two.  These two Signs shall be located along 91 Street and may include electronic changeable copy, backlit and/or illuminated signs.
