A Bylaw to amend Bylaw 12800, as amended,

The Edmonton Zoning Bylaw

Amendment No. 662

WHEREAS Lots 7, 8 and 9, Block 60A, Plan 052 0041; located south of 127 Avenue NW, between 90 and 90 Streets NW, Yellowhead Corridor, Edmonton, Alberta, are specified on the Zoning Map as (CB2) General Business Zone; and

WHEREAS an application was made to rezone the above described property to (DC2) Site Specific Development Control Provision;

NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:

1.       The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as Lots 7, 8 and 9, Block 60A, Plan 052 0041; located south of 127 Avenue NW, between 90 and 90 Streets NW, Yellowhead Corridor, Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule ”A”, from (CB2) General Business Zone to (DC2) Site Specific Development Control Provision.

2.      The uses and regulations of the aforementioned DC2 Provision are annexed hereto as Schedule "B".

3.       The sketch plan annexed hereto as Schedule ”A” and the uses and regulations of the DC2 Provision shown on Schedule ”B” annexed hereto are hereby incorporated into the Zoning Bylaw, being Part IV to Bylaw 12800, The Edmonton Zoning Bylaw.

DC2 SITE SPECIFIC DEVELOPMENT CONTROL PROVISION

1.       General Purpose

To allow for a limited range of commercial, light industrial, automotive and service uses with development regulations to ensure compatibility with surrounding land uses while minimizing the impact of development through development regulations including landscaping. 

2.       Area of Application

Lots 7, 8 & 9, Block 60A, Plan 052 0041 totaling 1.21 hectares; located on the south side of 127th Avenue, between 90th and 93rd Streets, Killarney, as shown on Schedule ”A” of this Bylaw, adopting this Provision.

3.         Uses

  1. General Industrial Uses, limited to the storage of new Automobiles and Autobody Repair/painting

  2. Automotive and Equipment Repair Shops

  3. Business Support Services

  4. Equipment Rentals

  5. General Retail Stores

  6. Household Repair Services

  7. Limited Contractor Services

  8. Minor Service Stations

  9. Professional, Financial and Office Support Services

  10. Warehouse Sales

  11. Fascia On-premises Signs

  12. Freestanding On-premises Signs

  13. Projecting On-premises Signs

  14. Temporary On-premises Signs

4.       Development Regulations

  1. Development of the Site shall be in accordance with the Site Plan attached to this provision, as Appendix I.

  2. The maximum Floor Area Ratio shall be 3.5.

  3. A minimum Landscaped Yard of 6.0m shall be required adjacent to 127 Avenue.  The installation of landscaping, boulevard trees, sidewalk and street lighting shall be in accordance with the approved SUB/02-0065 and landscape/engineering drawings as attached to Servicing Agreement C-352, and to the satisfaction of the Transportation and Community Services Departments.

  4. Landscaping plans for those areas of the site not included in Servicing Agreement C-352, shall be submitted in accordance with Section 55 of the Zoning Bylaw to the satisfaction of the Development Officer.

  5. A Building Setback of 13.0 m shall be required from the rear property line adjacent to Canadian National Railway.

  6. No parking, loading, storage, trash collection, outdoor service nor display area shall be permitted within a required Yard. Loading, storage and trash collection areas shall be screened from view from the adjacent public roadway, in accordance with the provisions of subsection 55.4 of the Zoning Bylaw.

  7. The orientation of overhead doors shall be directed to open away from the residential development on the north side of 127 Avenue.

  8. All operations, mechanical equipment and storage, with the exception of New Automobile Storage, shall be located within an enclosed building.

  9. The maximum Building Height shall not exceed 10.0 m or two and a half (2 1/2) storeys.

  10. Any business premises or multiple occupancy building having a Floor Area greater than 3000 m2 or a single wall length greater than 25.0 m visible from a public roadway, shall comply with the following criteria:

  1. the roof line and building façade shall include design elements that reduce the perceived mass of the building and add architectural interest; and

  2. Landscaping adjacent to exterior walls shall be used to minimize the perceived mass of the building and to create visual interest.

  1. All mechanical equipment, including roof mechanical units, shall be concealed by screening in a manner compatible with the architectural character of the building or concealed by incorporating it within the building.

  2. Signs shall comply with the regulations found in Schedule 59F of the Zoning Bylaw.

5.       Additional Development Regulations for General Industrial Uses

  1. All storage, display and parking areas shall be hardsurfaced in accordance with subsection 54.6(1) of the Zoning Bylaw;\

  2. All display areas that abut 127 Avenue shall be screened in accordance with the provisions of subsection 55.4(4) of the Zoning Bylaw; and

  3. Lighting for display areas shall be mounted on lamp standards and no exposed bulbs nor string of lights shall be used.
