A Bylaw to amend Bylaw 12800, as amended,

The Edmonton Zoning Bylaw

Amendment No.725

 

WHEREAS Lot 4, Block 9, Plan 042 5078, located at 4480 McCrae Avenue NW, Griesbach, Edmonton, Alberta, is specified on the Zoning Map as (DC2) Site Specific Development Control Provision; and

 

WHEREAS an application was made to rezone the above described property to (DC2) Site Specific Development Control Provision;

 

NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:

 

1.                  The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as Lot 4, Block 9, Plan 042 5078, located at 4480 McCrae Avenue NW, Griesbach, Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule ”A”, from (DC2) Site Specific Development Control Provision to (DC2) Site Specific Development Control Provision.

 

2.       The uses and regulations of the aforementioned DC2 Provision are annexed hereto as Schedule "B".

 

3.       The sketch plan annexed hereto as Schedule "A" and the uses and regulations of the DC2 Provision shown on Schedule "B" annexed hereto are hereby incorporated into the Zoning Bylaw, being Part IV to Bylaw 12800, The Edmonton Zoning Bylaw.

 

SCHEDULE "A"

 

 

SCHEDULE ”B”

(DC2) SITE SPECIFIC DEVELOPMENT CONTROL PROVISION

1.     General Purpose

To permit Extended Medical Treatment Services, residences for seniors including designated assisted living accommodation, and institutional uses and support services consistent with the objectives of the Griesbach Neighbourhood Area Structure Plan.

2.    Area of Application

Lots 3 and 4, Block 9, Plan 042 5078, located north of McCrae Avenue NW and east of Castledowns Road NW, Griesbach, shown on Schedule ”A”, annexed to the Bylaw adopting this DC2 Provision.

3.     Uses

Area A, as shown on Appendix 1

a.     Extended Medical Treatment Services

b.     Child Care Services, Community Recreation Services, Personal Service Shops and Health Services when designed as an integral and secondary component to an Extended Medical Treatment Services development

c.     Fascia On-premises Signs

d.      Freestanding On-premises Signs

Area B, as shown on Appendix 1

a.     Apartment Housing

b.     Boarding and Lodging Houses

c.     Minor Home Based Businesses

d.     Fascia On-premises Signs

4.     Development Regulations

a.     The site layout and building location shall be generally in accordance with the site plan as Appendix 1.

b.     The maximum number of Dwellings in Area B shall be 248.

c.     The maximum number of Sleeping Units in Area B shall be 42.

d.     The maximum number of Sleeping Units in Area A shall be 120.

e.     The minimum Site Area shall be 3000 m2.

f.      The minimum Site Width shall be 30 m.

g.    The maximum Floor Area Ratio for Apartment Housing shall be 1.3 for Area B, except it may be increased to 1.4 when underground parking is provided.

h.     For Area A:

i.     The minimum north Yard shall be 6.0 m.

ii.   The minimum south Yard shall be 6.0 m, except the minimum Yard between Area A and Area B may be 0.0 where buildings are linked.  

iii.    The minimum east and west Yards shall be 1.0 m for each Storey or partial Storey, except that a total of at least 2.0 m shall be provided.  A Side Yard shall not be less than 4.0 m where it abuts a lane or a public walkway.

i.     For Area B:

i.    The minimum north Yard shall be 6.0 m, except the minimum Yard between Area A and Area B may be 0.0 where buildings are linked.  The north yard may include a ramp for access to an underground parking garage.

ii.     The minimum south Yard shall be 3.0 m.

iii.    The minimum west Yard shall be 5.5 m.

iv.    The minimum east Yard shall be 2.0 m.

j.     The maximum Building Height shall not exceed 18.0 m nor 4 Storeys, provided that no eave line shall be higher than 14.0 m from Grade.  Floor Area may be developed in attic areas as additional space to a Dwelling, and not counted as a Storey, provided the additional Floor Area creates architectural interest to the design of the building and the development is within the maximum allowable Height.

k.    The maximum Building Height for Extended Medical Treatment Services shall not exceed 15.0 m nor 2 storeys.

l.    Separation Space for Apartment Housing and Boarding and Lodging Houses shall be provided in accordance with Section 48 of the Zoning Bylaw, except that the width of a front Privacy Zone shall not be required to exceed the width of the minimum Yard along a roadway specified in this Zone.

m.    A minimum Amenity Area of 7.5 m2 per Dwelling shall be provided.

n.   Any building having a Floor Area greater than 2000 m2 or a single wall length greater than 25.0 m visible from a public road, shall comply with the following criteria:

i.     the roof line and building façade shall include design elements that reduce the perceived mass of the building and add architectural interest; and

ii.     landscaping shall be used to minimize the perceived mass of the building and to create visual interest and an entry feature.

o.   Major mechanical equipment, including roof mechanical units, shall be concealed by screening in a manner compatible with the architectural character of the building or concealed by incorporating it within the building.

p.    Parking shall comply with Schedule 1 of Section 54.2 of the Zoning Bylaw, except parking for Apartment Housing for seniors will be not less than 0.5 parking spaces per Dwelling and parking for Boarding and Lodging Houses will be not less than 0.2 parking spaces per Sleeping Unit.  Parking will be permitted in the westerly Side Yard and Rear Yard of Area A and in the Rear Yard of Area B.

q.    Signs shall comply with the regulations found in Schedule 59B of the Zoning Bylaw.
