A Bylaw to amend Bylaw 12800, as amended,

The Edmonton Zoning Bylaw

Amendment No. 792

 

WHEREAS a portion of Block D, Plan 872 1140 and a portion of Lot 2, Block X, Plan 022 6318, located north of 25 Avenue SW and west of 88 Street SW, Summerside, Edmonton, Alberta, are specified on the Zoning Map as (AG) Agricultural Zone and (US) Urban Services Zone; and

 

WHEREAS an application was made to rezone the above described property to (RSL) Residential Small Lot Zone and (DC1) Direct Development Control Provision;

 

NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:

 

1.                  The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as a portion of Block D, Plan 872 1140 and a portion of Lot 2, Block X, Plan 022 6318, located north of 25 Avenue SW and west of 88 Street SW, Summerside Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule ”A”, from (AG) Agricultural Zone and (US) Urban Services Zone to (RSL) Residential Small Lot Zone and (DC1) Direct Development Control Provision.

 

2.       The uses and regulations of the aforementioned DC1 Provision are annexed hereto as Schedule ”B”.

(DC1) DIRECT DEVELOPMENT CONTROL PROVISION

 

1.                  General Purpose

 

         To accommodate Low Rise Apartments while ensuring a transitional area between residential and light industrial uses.

 

2.                  Area of Application

 

A portion of Block D, Plan 872 1140 and a portion of Lot 2, Block X, Plan 022 6318 located east of the Industrial Business lands, south of the Storm Water Management Facility and north of the 25th Avenue, Summerside, containing approximately 2.45 ha as shown on Schedule ”A” of this bylaw, adopting this provision.

 

3.                  Uses

 

a.       The Uses of Sections 210.2 and 210.3 of the Zoning Bylaw shall apply.

 

4.                  Development Regulations

 

a.       Development shall conform to Sections 210.4 and 210.5 of the Zoning Bylaw except that a 20 m. Setback to any habitable building shall be required from the western property boundary.  Surface vehicle parking shall be permitted within this Setback subject to the provision of the required landscaped Yard along the west property boundary.
