A Bylaw to amend Bylaw 12800, as amended,

The Edmonton Zoning Bylaw

Amendment No. 826

 

WHEREAS Lot 11, Block 126, Plan 2804AF; located east of 136 Street NW and north of 101 Avenue NW, Glenora, Edmonton, Alberta, is specified on the Zoning Map as (RF1) Single Detached Residential Zone; and

 

WHEREAS an application was made to rezone the above described property to (DC1) Direct Development Control Provision;

 

NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:

 

1.                  The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as Lot 11, Block 126, Plan 2804AF; located east of 136 Street NW and north of 101 Avenue NW, Glenora, Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule ”A”, from (RF1) Single Detached Residential Zone to (DC1) Direct Development Control Provision.

 

2.                  The uses and regulations of the aforementioned DC1 Provision are annexed hereto as Schedule ”B”.

(DC1) DIRECT DEVELOPMENT CONTROL PROVISION

1.        Purpose

This Provision is designed to accommodate the use and preservation of the William Blakey Residence, a Municipal Historic Resource.  This provision allows a Residential use within the existing building, while ensuring that any future alterations or the construction of an Accessory building are compatible with the designation of this building as a Municipal Historic Resource.

2.        Area of Application

This DC1 Provision shall apply to Plan 2804AF, Block 126, Lot 11, located at 13526 101 Avenue, Glenora, as shown on Schedule ”A” attached to the Bylaw adopting this DC1 Provision.

a.       Single Detached Housing

4.       Development Regulations

a.     All development shall be generally in accordance with the Site Plan, as illustrated on Appendix I.

b.     All new development shall be accommodated within the existing Residence and to the rear of the property, and maintain the architectural character of the William Blakey Residence, to the satisfaction of the Development Officer in consultation with the City of Edmonton Heritage Officer. 

c.     New development should be set back from the original side elevations and maintain the corner windows of the existing structure. 

d.     Any Accessory building to the rear shall be restricted to a garage and be complimentary to the William Blakey Residence.

e.     A landscaped Yard and a trash collection area shall be provided and developed in accordance with Section 55 of the Edmonton Zoning Bylaw.

f.     Modifications to the exteriors of the William Blakey Residence shall only be made in the event of necessary structural reinforcement or repairs, and shall conform to the provisions of the approved Municipal Designation Bylaw, and receive prior approval form the City of Edmonton Planning and Development’s Heritage Officer.

5.        Heritage Development & Design Regulations

These regulations ensure that the design of structural reinforcement or repairs, and cosmetic alterations will be sympathetic to the historical and architecturally significant facades of the William Blakey Residence.  The Development Officer shall have regard to the following regulations when reviewing development applications:

 

a.     Any future development shall conform to the ”Standards and Guidelines for the Conservation of the Historic Places in Canada” published by Parks Canada.

 

b.     Any development shall conform to the requirements of the City of Edmonton Designation Bylaw 14586 and Policy C-450A’s General Guidelines for Rehabilitation.

 

c.     The design and appearance of any additions and/or alterations shall complement the original historical building in scale, proportion, architectural style, detail and materials to the satisfaction of the City of Edmonton’s Development Officer and Heritage Officer.

 

d.     No new development shall exceed the height of the existing structure.
