A Bylaw to amend Bylaw 12800, as amended,

The Edmonton Zoning Bylaw

Amendment No. 848

 

WHEREAS a portion of Lot 1, Plan 782 0613, located south of Ellerslie Road SW and west of 66 Street SW. Summerside, Edmonton, Alberta, is specified on the Zoning Map as (AG) Agricultural Zone; and

 

WHEREAS an application was made to rezone the above described property to (RA7) Low Rise Apartment Zone and (DC2) Site Specific Development Control Provision;

 

NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:

 

1.       The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as a portion of Lot 1, Plan 782 0613, located south of Ellerslie Road SW and west of 66 Street SW. Summerside, Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule ”A”, from (AG) Agricultural Zone to (RA7) Low Rise Apartment Zone and (DC2) Site Specific Development Control Provision.

 

2.       The uses and regulations of the aforementioned DC2 Provision are annexed hereto as Schedule "B".

 

3.       The sketch plan annexed hereto as Schedule "A" and the uses and regulations of the DC2 Provision shown on Schedule "B" annexed hereto are hereby incorporated into the Zoning Bylaw, being Part IV to Bylaw 12800, The Edmonton Zoning Bylaw.

DC2 - SITE SPECIFIC DEVELOPMENT CONTROL PROVISION

 

1.       General Purpose

 

To establish a Site Specific Development Control Zone to provide for neighborhood convenience and personal service uses capable of meeting the needs of the surrounding communities, while specifically prohibiting Alcohol Sales and being compatible with adjacent surrounding low density residential and institutional uses.

 

2.       Area of Application

 

Lot 1, Plan 782 0613, located south of Ellerslie Road and west of 66 Street SW, Summerside, as shown on Schedule ”A” of this Bylaw adopting this Provision.

 

3.       Uses

 

a.                    Child Care Services

b.                   Convenience Retail Stores

c.                    Drive-in Food Services

d.                   Gas Bars

e.                    General Retail Stores

f.                     Government Services

g.                   Health Services

h.                   Minor Secondhand Stores with a Floor Area less than 275 m2

i.                     Minor Service Stations

j.                     Personal Service Shops

k.                    Professional, Financial and Office Support Services

l.                     Public Libraries and Cultural Exhibits

m.                  Rapid Drive-through Vehicle Services

n.                   Residential Sales Centre

o.                   Restaurants, for less than 100 occupants and 120 m2 of Public Space

p.                   Specialty Food Services, for less than 100 occupants and 120 m2 of Public Space

r.                     Fascia On-premises Signs

4.       Development Regulations

 

a.                    The Site layout and building locations shall be in accordance with the Site plan as illustrated in Appendix I

b.                   The maximum Building Height shall not exceed 10.0 m nor 2 1/2 Storeys.

c.                    The maximum Floor Area Ratio shall be 1.0.

d.                   The maximum Floor Area of any individual business premises shall not exceed 275 m2.

e.                    A minimum landscaped Yard of 4.5 m shall be provided along Ellerslie Road SW, 66 Street SW, and 70 Street SW. 

f.                     A minimum landscaped Yard of 6.0 m with a 1.0 m berm with a 1.8 m screen fence shall be provided along the south property line.

g.                   An all directional curb return access to 70 Street SW including curb ramps on both sides shall be located 12 m from the south property line of the site.

h.                   A right-in/right out curb return access to Ellerslie Road including curb ramps on both sides shall be located 100 m from the west property line. The owner shall construct an eastbound right turn bay to this access.  The owner shall construct an eastbound right turn bay to this access.

i.                     A right-out only curb return access to 66 Street including curb ramps on both sides shall be located 6 m from the south property line. 

j.                     A 2.1 m x 9.0 m transit pad with a 2 m x 3 m shelter pad shall be located on the east side of 70 Street (25 m north of the access), south side of Ellerslie Road SW (25 m east of the west curb line) and west side of 66 Street SW (70 m south of the north property line).

k.                    Sidewalks shall be located in accordance with the Site plan.

l.                     Loading, storage and trash collection areas shall be screened from view in accordance with the regulations of Section 55 of the Zoning Bylaw.

m.                  All development shall be required to comply with but are not limited to the following Architectural Guidelines:

i.                    All development on a Site shall be constructed using architectural themes that are consistent.  Exterior wall finish materials for all development shall be of high quality and consistent on all sides with the overall architectural style for the Area of Application.

ii.           Entrances should be emphasized using colour, texture and architectural elements.  Gateways and site entries shall be developed with special landscape treatments including, but not limited to, trees and shrubs, accents, paving treatments, lighting or compatible architectural elements

iii.                 All exterior lighting shall be designed such that all light is contained within the Area of Application, to be indirect from all angles of off-site viewing, and not intrude into neighbouring residential area, and shall incorporate design elements consistent with the architectural themes for the development.

iv.                Architectural treatment of buildings shall continue to the side elevations where it is specified as a primary building façade as identified in Appendix 1. Architectural devices for achieving this include the continuation of architectural details such as cornices, accent banding, masonry pillars & raised details. Glazing on these elevations is encouraged, where possible.   

v.                  Building ’E’ is to incorporate a special architectural element such as a tower, spire or clock not to exceed 12.0m in height.

vi.                The rear walls of Buildings ’E’, ’F’ & ’G’ are to have additional treatment such as accent banding/graphics or other architectural devices to create visual interest.

vii.               Architectural design shall be to the satisfaction of the Development Officer.

n.                   The sidewalks/walkways in front of Buildings ’E’, ’F’ & ’;G’ shall be a minimum of 2.0 m and all other sidewalks/walkways shall be a minimum of 1.5 m.

o.                   A public access easement shall be registered for the sidewalk developed within the site along 66 Street SW.

p.                   Landscaping shall be in accordance with Section 55 of the Zoning Bylaw.  Notwithstanding Section 55, landscaping shall be provided generally in accordance with the landscaping concepts illustrated in Appendix I and clauses q and r to create a consistently high quality landscape treatment that will enhance the visual appearance of the development as a whole.  The landscaping plan shall be designed by a landscape architect.

q.                   The south edge of Building ’I’ shall incorporate a landscaped area that includes a minimum of 3 deciduous trees and 3 shrubs.

r.                     Enhanced landscaping shall be provided at the rear of Buildings ’E’, ’F’ & ’G’ consisting of 15 coniferous trees that are a minimum 2.0 m in height and 6 deciduous trees that are a minimum 75 mm caliper.

s.                    Vehicular and bicycle parking shall comply with the regulations of Section 54 of the Zoning Bylaw.

t.                     Signs shall comply with the regulations contained in Schedule 59D of the Zoning Bylaw.
