WHEREAS Area A, Plan 972 1206 and a portion of Block X, Plan 4350R, located on the northwest corner of 97 Street and Yellowhead Trail, Yellowhead Corridor, Edmonton, Alberta, are specified on the Zoning Map as (AJ) Alternative Jurisdiction Zone; and
WHEREAS an application was made to rezone the above described property to (DC2) Site Specific Development Control Provision;
NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:
1. The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as Area A, Plan 972 1206 and a portion of Block X, Plan 4350R, located on the northwest corner of 97 Street and Yellowhead Trail, Yellowhead Corridor, Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule ”A”, from (AJ) Alternative Jurisdiction Zone to (DC2) Site Specific Development Control Provision.
2. The uses and regulations of the aforementioned DC2 Provision are annexed hereto as Schedule "B".
3. The sketch plan annexed hereto as Schedule ”A” and the uses and regulations of the DC2 Provision shown on Schedule ”B” annexed hereto are hereby incorporated into the Zoning Bylaw, being Part IV to Bylaw 12800, The Edmonton Zoning Bylaw.

SCHEDULE ”B”
(DC2) SITE SPECIFIC DEVELOPMENT CONTROL PROVISION
1. General Purpose
To allow for the ongoing use and development of this site for a limited range of commercial uses and ensure that environmental contamination on the Site has been mitigated to the extent necessary to ensure that development meets acceptable standards on any portion of the Site.
2. Application
Area A, Plan 972 1206 and a portion of Area X, Plan 4350 R, approximately 0.57 hectares; located on the north west corner of 97 Street and Highway 16 (Yellowhead Trail), Yellowhead Trail Area Structure Plan, as shown on Appendix 1 of this Bylaw, adopting this Provision.

a. Automotive and Equipment Repair Shops
b. Equipment Rentals
c. General Retail Stores
d. Household Repair Services
e. Limited Contractor Services
f. Minor Second-hand Stores
g. Major Second-hand Stores
h. Minor Service Stations
i. Professional, Financial and Office Support Services
j. Fascia On-premises Signs
k. Freestanding On-premises Signs
l. Projecting On-premises Signs
m. Temporary On-premises Signs
4. Development Regulations
a. A descriptive Plan of Consolidation for the two lots must be registered by an Alberta Land Surveyor and submitted as part of the application for a Development Permit for the area shown on Appendix 1.
b. As per Section 720.3 (3) of the Zoning Bylaw, all regulations in the Zoning Bylaw shall apply to this Direct Control Provision unless specifically excluded or modified by the regulations contained herein.
c. The maximum Floor Area Ratio shall be 3.5.
d. A minimum landscaped yard of 4.5 m shall be required where the Site abuts a public roadway, and a minimum landscaped yard of 3.0 m shall be required around the remainder of the Site.
e. No parking, loading, storage, trash collection, outdoor service or display area shall be permitted within a required Yard. Loading, storage and trash collection areas shall be located to the rear or sides of the principal building and shall be screened from view from any adjacent Sites, public roadways or Light Rail Transit lines in accordance with the provisions of subsection 55.4 of this Bylaw.
f. The maximum Building Height shall not exceed 14.0 m nor four Storeys.
g. Any business premises or multiple occupancy building having a Floor Area greater than 3000 m2 or a single wall length greater than 25.0 m visible from a public road, shall comply with the following criteria:
a. the roof line and building façade shall include design elements that reduce the perceived mass of the building and add architectural interest; and
b. landscaping adjacent to exterior walls shall be used to minimize the perceived mass of the building and to create visual interest.
h. All mechanical equipment, including roof mechanical units, shall be concealed by screening in a manner compatible with the architectural character of the building or concealed by incorporating it within the building.
i. Signs shall comply with the regulations found in Schedule 59F.
j. Landscaping shall be provided in accordance with Section 55 of Bylaw 12800.
