WHEREAS Lots 1 and 2, Block 59, Plan 912 3306, located north of 160 Avenue NW and east of 82 Street NW, Mayliewan, Edmonton, Alberta, are specified on the Zoning Map as (DC2) Site Specific Development Control Provision and (RF5) Row Housing Zone; and
WHEREAS an application was made to rezone the above described property to (DC2) Site Specific Development Control Provision;
NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:
1. The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as Lots 1 and 2, Block 59, Plan 912 3306, located north of 160 Avenue NW and east of 82 Street NW, Mayliewan, Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule ”A”, from (DC2) Site Specific Development Control Provision and (RF5) Row Housing Zone to (DC2) Site Specific Development Control Provision.
2. The uses and regulations of the aforementioned DC2 Provision are annexed hereto as Schedule "B".
3. The sketch plan annexed hereto as Schedule ”A” and the uses and regulations of the DC2 Provision shown on Schedule ”B” annexed hereto are hereby incorporated into the Zoning Bylaw, being Part IV to Bylaw 12800, The Edmonton Zoning Bylaw.
SCHEDULE "B"
To establish a Site Specific Development Control Provision to accommodate a limited range of commercial land uses with development regulations to ensure compatibility with the surrounding land uses.
This provision shall apply to Lots 1 and 2, Block 59, Plan 9123306, as shown on Schedule "A" appended to the Bylaw adopting this Provision.

Development on this site shall generally be in accordance with the following regulations and Appendix I.
The maximum gross area for any individual business premise shall not exceed 558 m2.
Development setbacks shall be provided as follows:
a minimum setback of 10m from the north property line;
a minimum setback of 6.8m from the west property line;
a minimum setback of 28m from the east property line;
a minimum setback of 24.7m from the south property line.
Landscaped yards shall be provided as follows:
a minimum width of 6.3m adjacent to the north property line;
a minimum width of 3.5m adjacent to south and west property lines;
a minimum width of 10.7m adjacent to the east property line.
Landscaping shall be provided in accordance with the Zoning Bylaw and will include the provision of a 1.8m high screen fence along the north and east property lines.
The owner shall enter into an Agreement with the City of Edmonton, in conjunction with the development permit, for off-site improvements necessary to serve the development. The agreement process may include an engineering drawing review and approval process. Improvements to be addressed in the Agreement include but are not limited to the following:
Widening of the existing access to a width of 10 m; and
Repair of any damage to the abutting roadways, sidewalks and/or boulevards resulting from construction of the development, to the satisfaction of the Transportation Department. The site must be inspected by the Transportation Department prior to the start of construction and once again when construction is complete.
A detailed landscape plan prepared by a Registered Landscape Architect must be submitted to the satisfaction of the Development Officer in consultation with the Parks Branch with any application for development.
Development in this Provision shall be evaluated with respect to compliance with the General Development Regulations of Sections 50 to 79 inclusive, of the Zoning Bylaw.
The Development Officer may grant relaxation to Sections 50 to 79 inclusive of the Zoning Bylaw and the provisions of this DC2 Provision, if, in his/her opinion, such a variance would be in keeping with the General Purpose of this Provision and would not affect the amenities, use, enjoyment and value of neighbouring properties.
