A Bylaw to amend Bylaw 12800, as amended,

The Edmonton Zoning Bylaw

Amendment No. 1059

 

WHEREAS Lot 5, Block 9A, Plan 0627891, located at 6504-137 Avenue NW, York, Edmonton, Alberta, is specified on the Zoning Map as (US) Urban Services Zone; and

 

WHEREAS an application was made to rezone the above described property to (DC2) Site Specific Development Control Provision;

 

NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:

 

1.       The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as Lot 5, Block 9A, Plan 0627891, located at 6504-137 Avenue NW, York, Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule "A", from (US) Urban Services Zone to (DC2) Site Specific Development Control Provision.

 

2.       The uses and regulations of the aforementioned DC2 Provision are annexed hereto as Schedule "B".

 

3.        The sketch plan annexed hereto as Schedule "A" and the uses and regulations of the DC2 Provision shown on Schedule "B" annexed hereto are hereby incorporated into the Zoning Bylaw, being Part IV to Bylaw 12800, The Edmonton Zoning Bylaw.

 

SCHEDULE "B"

 

(DC2) SITE SPECIFIC DEVELOPMENT CONTROL PROVISION

 

 

1.          General Purpose

 

            To facilitate disposal of surplus City of Edmonton property, consisting of the land and building of the former Londonderry Police Station.  Redevelopment will be to medium density residential use similar and compatible to development to the north and east.

 

2.         Area of Application

 

            Lot 5, Block 9A, Plan 062 7891, as shown on Schedule "A" attached to this Bylaw.

    1. Apartment housing

    2. Minor home based business

    3. Fascia on premises signs

    4. Projecting on premises signs

    5. Residential sales centre

    6. Temporary on premises signs

4.        Development Regulations

  1.  

    1. Development on this site shall be generally in accordance with the following regulations and site plan illustrated in Appendix I of this Bylaw and the elevation drawing shown as Appendix II.

    2. The maximum number of units shall be 79 units.

    3. Maximum building height shall be 20.0 m (66’-10”) or 5 storeys with lofts.

    4. A building setback of 4.5 m shall be provided adjacent to the west, north and east property lines with outdoor amenity areas encroaching no more than 0.6 m into setbacks.

    5. A building setback of 4.6 m shall be required from the existing parking lot line.

    6. Landscaped yards corresponding to the building setback shall be provided to the west, north and east property lines.

    7. A detailed Landscape Plan shall be submitted in accordance with Section 55 of the Zoning Bylaw prior to the approval of any development.  This plan shall include fencing details, exterior lighting and street furniture elements, pedestrian seating areas, size and type of new plantings and soil depths for the entire Site and including special treatment to clearly delineate public access to any outdoor amenity areas.

    8. A minimum private Amenity Area of 7.5 m2 per Dwelling shall be provided.

    9. A public Amenity Area measuring approximately 65 m2  and including, but not limited to interlocking pavers complete with a trellis and 3 benches, shall be provided , as shown on the site plan attached as Appendix I to this Bylaw.

    10. Underground and surface parking shall be provided in accordance with Section 54.2 of the Edmonton Zoning Bylaw 12800.

    11. The underground driveway ramp shall be at grade at the property line and shall have a maximum slope of 6% for the first 4.5 m and a maximum slope of 17% for an additional 4.5 m.

    12. Bicycle parking shall be provided in accordance with Section 54.3 of the Zoning Bylaw.

    13. The existing access easement must be maintained to allow for the continued right-in/right-out access to 137 Avenue from the subject site and the site located immediately west of the parcel.

    14. Trash collection areas shall be screened from view from public roadways.

    15. Signs shall comply with the regulations found in Schedule 59B.

5.        Urban Design Regulations

 

  1. All development shall be required to comply with, but are not limited to, the following architectural guidelines, to the satisfaction of the Development Officer:

    1. Architectural treatments such as canopies, variation and building form, facades, varying heights and roof lines and a variety of materials are encouraged for the building to create visual interest and to minimize perceived mass.

    2. The use of exterior wall finishing material shall be of high environmental quality and be harmonious with the architectural style established for the area and shall be predominantly proposed of muted colors with strong colors limited to use as an accent.

    3. Exterior finish treatment on all sides of the building shall be consistent with one material predominant for the exterior finish of each side.

    4. Appropriate lighting of the building and the Site shall be undertaken to provide safe, adequately lit environment.

  2. The Development Officer shall require the submission of Crime Prevention Through Environmental Design (CPTED) assessment prepared by a qualified security consultant for the development on the subject site.  The Development Officer shall advise applicants of the approved crime prevention design guidelines contained in the Design Guide for a Safer City, such as the layout and design of buildings and associated parking and loading areas, yards and landscaped areas, to promote a safe, well-lit physical environment.
