(DC1) SITE SPECIFIC DEVELOPMENT CONTROL PROVISION

1.         Purpose

This Provision is designed to accommodate the use and preservation of the Otto Reiher Cottage, a Municipal Historic Resource.  This provision allows a Residential use within the existing building, while ensuring that any future alterations to the Residence and existing Accessory building are compatible with the designation of this building as a Municipal Historic Resource.

2.         Area of Application

This Provision shall apply to Lot 18, Block 47, Plan 5081HW, Newton, as shown on Schedule "A” attached to the Bylaw adopting this DC1 Provision.

3.         Uses

  1. Single Detached Housing

  2. Garage Suite

  3. Major Home Based Business

  4. Minor Home Based Business

  5. Fascia On-premises Signs

  6. Freestanding On-premises Signs

4.         Development Regulations

  1. All new development shall be accommodated within the existing Residence and within the existing building footprint and envelope of the Accessory building, as shown on Appendix 1.  New development to the Residence shall maintain the architectural character of the Otto Reiher Cottage, and new development to the Accessory building shall compliment the Otto Reiher Cottage, to the satisfaction of the Development Officer in consultation with the City of Edmonton Heritage Officer.

  2. Modifications to exterior features of the Otto Reiher Cottage that are regulated or preserved shall only be made in the event of necessary structural reinforcement or repairs, and shall conform to the provisions of the approved Municipal Designation Bylaw, and receive prior approval from the City of Edmonton Heritage Officer.

  3. A Garage Suite shall be developed in accordance with the following regulations:

  1. a Garage Suite shall only be developed within the existing building footprint and envelope of the Accessory building, as shown in Appendix 1;

  2. windows contained within the Garage Suite portion of the Accessory building shall be placed and sized such that they minimize overlook into yards and windows of abutting properties through one or more of the following:

  1. off-setting window placement to limit direct views of abutting rear or side yard amenity areas, or direct view into a Garage Suite or Garden Suite window on an abutting Site;

  2. strategic placement of windows in conjunction with landscaping or the placement of other accessory buildings; and

  3. placing larger windows such as living room windows, to face a lane, a flanking street, or the larger of any Side Yard abutting another property.

  1. no decks or platform structures shall be allowed as part of the Garage Suite;

  2. notwithstanding the definition of Household within this Bylaw, the number of unrelated persons occupying a Garage Suite shall not exceed three; and

  3. a Garage Suite shall not be separated from the principal Dwelling through a condominium conversion or subdivision.

  1. Signs, and Lighting for Signs, shall be integrated into the historical character of the Otto Reiher Cottage to the satisfaction of the Development Officer in consultation with the City of Edmonton Heritage Officer, and shall comply with the following regulations:

  1. a maximum of one Fascia On-premises Sign shall be allowed.  The maximum Area shall not exceed 0.30 m2 and the top shall not extend above the building roof.

  2. a maximum of one Freestanding On-premises Sign shall be allowed.  The maximum Area shall not exceed 0.60 m2 and no portion of the sign shall project beyond the property line.  The maximum Height shall be 1.2 m.

5.      Heritage Development & Design Regulations

These regulations ensure that the design of structural reinforcement or repairs, and cosmetic alterations will be sympathetic to the historical and architecturally significant facades of the Otto Reiher Cottage.  The Development Officer shall have regard to the following regulations when reviewing development applications:

  1. Any future development shall conform to the "Standards and Guidelines for the Conservation of Historic Places in Canada” published by Parks Canada.

  2. Any development shall conform to the requirements of the City of Edmonton Heritage Designation Bylaw 14379 and the General Guidelines for Rehabilitation within Policy C-450B.

  3. The design and appearance of any additions and/or alterations shall complement the original historical building in scale, proportion, architectural style, detail and materials to the satisfaction of the City of Edmonton’s Development Officer and Heritage Officer.
