To accommodate the development of low rise apartment housing, establish development regulations that are designed to create a building that is compatible with the scale of abutting residential development to the west and provides architectural features that ensure privacy for residents in the development, and contributes to the pedestrian oriented character of 112 Street.
Lots 140, 141, and 142, Block 12, Plan B4, located south of 103A Avenue and west of 112 Street, Oliver, as shown on Schedule ”A” of this Bylaw, adopting this provision.

Development shall be in accordance with the Site Plan, Elevations and Perspective, as illustrated on Appendices 1, 2, 3 and 4. (Appendix 4 is an architectural guideline).
The maximum Height shall not exceed 16 metres nor 4 Storeys.
The maximum number of Dwellings shall be 47.
The maximum Floor Area Ratio shall be 1.75.
Apartment Housing shall be designed in accordance with the following criteria:
Vehicular access to underground and visitor parking shall be provided from the lane along the west boundary of the Site;
The style of the building shall attempt to create a façade that is compatible with neighbouring residential developments;
All exterior finishing material must be of a high quality, durable, and attractive in appearance, and all exposed building faces shall have consistent and harmonious exterior finishing materials;
The north and east elevations will be finished with architectural accents that are complementary with and sympathetic to surrounding developments; and
Architectural metal fencing will be constructed on the perimeter of the Site along 112 Street and 103A Avenue. The 103A Avenue metal fence shall be constructed within the north property line and terminating at the western face of the building. Openings of sufficient width, to permit safe exiting from the building, are to be provided in the fence.
The minimum Yards shall be:
4.5 m from 112 Street, on the east boundary of the Site;
1.2 m from the south boundary of the Site; and
1.2 m from 103A Avenue on the north boundary of the Site.
The minimum building Setback shall be 17.5 m from the west boundary of the site adjacent to the existing Lane.
Patios shall be designed to create a clear distinction between private and public space using fencing or landscaping to create privacy for residents of the building, to the satisfaction of the Development Officer.
To ensure that a high standard of appearance is achieved, detailed Landscaping plans shall be submitted with the initial Development Permit application for approval by the Development Officer in consultation with the Community Services Department. Such landscaping plans shall include boulevard trees on frontage along 112 Street, and shall be in accordance with Section 55 of the Zoning Bylaw and shall be to the satisfaction of the Development Officer.
The Development Officer shall require, as a condition of approval, that the applicant provide an irrevocable letter of credit in the amount of 100% of the established landscaping cost, the conditions of the security being that:
if the Landscaping is not completed in accordance with the Development Criteria of this Provision and the Landscaping plan, within one growing season after the completion of the development, then the amount fixed shall be paid to the City for its’ use absolutely; and
the Development Officer shall not release the letter of credit until an inspection of the site has demonstrated that the Landscaping has been well maintained and is in a healthy condition two growing seasons after completion of the landscaping.
Parking shall be provided in accordance with Section 54 of the Zoning Bylaw. The underground parkade will be constructed completely below Grade, and the surface parking area shall be screened by a wood fence. The wood fence shall be constructed within the west property line, as shown in the site plan, and within the north property line to the western face of the building. The wood fence shall be painted in a colour complementary to the colour of the apartment building.
No parking, loading, storage, trash collection, outdoor service, or display area shall be permitted within a required yard on the north, east, or south side of the site. Loading and trash collection areas shall be located in such a manner as to be screened from view from adjacent sites and public roadways, and the parkade ramp shown on the Site Plan shall be screened by a fence constructed along the south and east sides of the ramp to the satisfaction of the Development Officer.
Signs shall comply with the regulations found in Section 59B of the Zoning Bylaw.
